Terms and conditions
5TO ELEMENTO S.A.S.
These terms and conditions govern the relationship between 5TO ELEMENTO S.A.S. and travelers, clients, or participants who contract any of the tourism services offered by the company.
By making a reservation, making a payment, or participating in an activity organized by 5TO ELEMENTO S.A.S., the traveler declares having read, understood, and accepted the conditions established in this document.
Acceptance of the Terms and Conditions
Upon making a reservation and the corresponding payment, the traveler freely and voluntarily accepts:
- The characteristics of the contracted service.
- The established itinerary.
- The operational conditions of the activity.
- The risks associated with nature, adventure, or mountain activities.
- The participant’s responsibilities.
- The cancellation, modification, and refund policies.
The traveler declares that the information provided during the booking process is true, complete, and up-to-date.
Information about the Booked Service
Before making a booking, the client will receive information related to:
- Description of the activity.
- Duration.
- Level of difficulty.
- Equipment and clothing recommendations.
- Physical requirements.
- Meeting point.
- Schedule.
- Included and excluded services.
- Applicable special conditions.
The traveler is responsible for reviewing this information and promptly communicating any personal conditions that may affect their participation.
Booking Confirmation
A booking will only be valid when:
- There is confirmed availability from 5TO ELEMENTO S.A.S.
- The client has made the requested payment or deposit.
- The company has sent confirmation through official channels.
The company may reject or modify requests when there is no availability, suitable operating conditions, or when the activity is not recommended for the participant’s safety.
Tour Modifications
5TO ELEMENTO S.A.S. may partially or completely modify an itinerary when necessary due to:
- Weather conditions.
- Participant safety.
- Road or trail conditions.
- Environmental restrictions.
- Decisions of competent authorities.
- Force majeure or unforeseen circumstances.
These modifications may include:
- Schedule changes.
- Route changes.
- Change of assigned guide.
- Change of operating point.
- Substitution of one activity with an equivalent one.
When possible, the company will offer an alternative that maintains equal or superior quality to the service initially contracted.
Nature, Adventure, and Mountain Activities
The traveler acknowledges that some activities offered by 5TO ELEMENTO S.A.S., including hiking, trekking, expeditions, activities above 3,000 meters in altitude, rural tours, and adventure experiences, may involve natural risks inherent to the environment.
These risks may include:
- Sudden weather changes.
- Rain, cold, or sun exposure. Uneven terrain.
- Paths with mud, rocks, or slopes.
- Physical fatigue.
- Altitude sickness.
- Falls or accidental injuries.
- Contact with wildlife or natural elements.
The participant acknowledges these risks and agrees to follow all safety recommendations provided by the company and its guides.
Services Contracted with Third Parties
During the course of a tourist experience, the traveler may contract additional services directly with third parties.
These services may include, among others:
- Additional activities.
- Meals not included.
- Transportation contracted separately from the service.
- Experiences offered by external operators.
Any service contracted directly by the traveler with third parties will be the sole responsibility of the corresponding provider.
5TO ELEMENTO S.A.S. will not be liable for accidents, losses, damages, breaches of contract, or situations arising from services contracted directly between the traveler and third parties.
These activities will also not be covered by the insurance or assistance contracted by the company, unless they are part of the official service purchased with 5TO ELEMENTO S.A.S.
Required Documentation
The traveler must carry a valid and current identification document during the activity.
Colombian citizens:
- National ID card.
- Identity card for minors.
Foreign citizens:
- Valid passport.
- Immigration document required by Colombian authorities, when applicable.
Failure to provide the required documentation may prevent participation in the activity.
In these cases, 5TO ELEMENTO S.A.S. will not assume financial responsibility nor be obligated to issue refunds when the inability to participate is due to the traveler’s negligence.
Traveler Responsibility
Participants agree to:
- Follow the instructions of the guide or authorized personnel.
- Maintain respectful behavior.
- Take care of the natural areas visited.
- Respect local communities and other visitors.
- Use the equipment provided properly.
- Inform participants of any relevant medical conditions before the activity begins.
Prohibited Conduct
5TO ELEMENTO S.A.S. may remove from the activity any participant who:
- Endangers their own safety or the safety of other travelers.
- Fails to follow the guide’s instructions.
- Engages in aggressive, disrespectful, or illegal behavior.
- Being under the influence of alcohol or substances that impair their abilities.
- Damaging facilities, equipment, or ecosystems.
In these cases, the traveler may be excluded from the activity without the right to a refund.
Environmental Protection and Responsible Behavior
Travelers must comply with the principles of responsible tourism:
- Do not litter in natural areas.
- Do not remove plants, animals, minerals, or natural objects.
- Do not feed wildlife.
- Respect authorized trails.
- Follow the rules of natural parks and local communities.
The traveler will be responsible for environmental damage caused by voluntary or negligent actions.
Declaration of Health and Physical Condition
The traveler declares, under their own responsibility, that they are in adequate physical and mental condition to participate in the contracted activity.
The participant declares that:
- They do not have any medical conditions that could pose a risk during the activity.
- They will inform the organizers in advance of any relevant health conditions.
- They will not participate under the influence of alcohol, drugs, or medications that impair their ability to react.
- They understand the physical demands of the selected experience.
The traveler must specifically report situations such as:
- Cardiovascular diseases.
- Respiratory problems.
- Mobility limitations.
- Recent injuries.
- Recent surgeries.
- Pregnancy.
- Medical conditions that may be aggravated during the activity.
Failure to provide relevant information may affect the safety assessment and limit the company’s liability for consequences arising from said omission.
Minors
Minors may participate only when:
- The activity is appropriate for their age.
- They are accompanied by a responsible adult when applicable.
- They have authorization from their legal representatives when required.
The responsible adult must report any medical or other relevant information about the minor.
Safety and Assistance Equipment
When required by the activity, 5TO ELEMENTO S.A.S. will provide or indicate the necessary equipment to ensure a safe experience.
The traveler must:
- Use the provided equipment correctly.
- Follow the instructions for use.
- Report any damage or problems.
The company has operational measures in place to minimize risks; however, no activity in natural environments is completely free of unforeseen events.
