TERMS & CONDITIONS
1. ACCEPTANCE OF TERMS
By registering and making the reservation payment, the traveler freely and voluntarily declares that they accept the terms and conditions described herein, as well as compliance with the activities, features, and services included in the selected tour package.
2. MODIFICATIONS TO TOURS
5to Elemento Tours may modify itineraries, schedules, activities, dates, or assigned guides in case of extraordinary, climatic, or force majeure circumstances. In all cases, changes will guarantee a quality equal to or higher than initially contracted.
3. EXTERNAL SERVICES
Any service or additional activity contracted directly by the traveler with third parties during the tour will be the sole responsibility of the traveler. 5to Elemento Tours is not responsible for accidents, losses, inconveniences, or any other situation derived from such contracts, and these events are not covered by the company’s insurance policy.
4. REQUIRED DOCUMENTATION
The traveler must carry and present a valid and current identification document. For Colombian citizens, a national ID card (cédula de ciudadanía) or identity card for minors is required. For foreigners, a valid passport must be presented. Failure to comply with this obligation releases 5to Elemento Tours from any legal or financial responsibility arising from the traveler’s inability to participate in the tour.
5. TRAVELER’S RESPONSIBILITY
5to Elemento Tours does not assume legal responsibility for improper, illegal, or dangerous behavior by the traveler, which may result in their exclusion from the tour without the right to a refund. Nor for injuries, accidents, losses, or damages caused by recklessness, negligence, or failure to follow the instructions given by guides or drivers. Travelers must also avoid causing environmental damage, such as leaving waste. The traveler agrees to follow the guide’s instructions and act responsibly with the natural environment of the Coffee Region.
6. HEALTH DECLARATION AND PHYSICAL CONDITIONS
The traveler declares under their sole responsibility that they do not suffer from cardiovascular, respiratory, or mental illnesses, nor are pregnant. They do not suffer from conditions such as asthma, epilepsy, diabetes, schizophrenia, or similar. They assume risks if they have undergone surgery in the last year or have prostheses. They confirm being of legal age or authorized by a representative, in optimal physical and mental condition, not under the influence of alcohol or drugs, and having received a clear explanation of the risks involved in the activity and the necessary safety measures. They agree to follow the guide’s instructions at all times, assume responsibility for their actions, and understand the scope of assistance insurance.
7. CANCELLATION POLICY
A 100% refund of the reservation value will be granted if the cancellation is made at least 24 hours in advance for most tours. For special activities such as paragliding or Santa Rosa de Cabal Hot Springs, a 50% refund will be granted if canceled up to 24 hours in advance. Cancellations made less than 24 hours in advance will not be entitled to a refund.
8. AUTHORIZATION FOR PERSONAL DATA PROCESSING AND IMAGE USE
In compliance with Colombian laws, the traveler authorizes 5to Elemento Tours to process their personal data for reservation management, communication, and promotional purposes. The traveler also authorizes the company to capture and use their image (photographs and/or videos taken during the tour activities) for advertising, promotional, commercial, and dissemination purposes through social media, digital media, printed materials, the official website, and other communication channels of the company. This authorization does not imply any financial compensation for the traveler. If the traveler does not authorize image use, they must notify the company in writing before the start of the tour. Data rights include access, correction, deletion, and complaints before the Colombian authorities.
